Examples of traumatic brain injuries include concussions, contusions (bruising of the brain tissue), and penetrating head injuries. TBIs can cause a wide range of physical, cognitive, emotional, and behavioral symptoms.
In addition to traumatic brain injury, there is also acquired brain injury (ABI). While TBI refers to brain damage caused by a sudden impact or violent motion, ABI refers to brain damage caused by a non-traumatic event, such as a stroke, an infection, or a lack of oxygen to the brain.

Common symptoms of traumatic brain injuries may include headaches, dizziness, confusion, memory loss, difficulty speaking or understanding language, changes in mood or behavior, and physical impairments such as paralysis or weakness in the limbs. The leading causes of TBI hospitalizations and deaths in Washington state were falls and motor vehicle accidents. Falls accounted for 55% of TBI hospitalizations and 30% of TBI deaths, while motor vehicle accidents accounted for 19% of hospitalizations and 39% of deaths.
Overall, the incidence of TBI in Washington state was 215 hospitalizations and 29 deaths per 100,000 people per year. However, it is important to note that not all brain injuries are severe enough to require hospitalization, and many brain injuries may go undiagnosed or unreported.
Some victims might wonder if they can still recover money in a lawsuit if their own behavior caused some of the accident. The answer to this question is whether the state the suit is being brought follows the doctrine of comparative fault.
The doctrine of comparative fault, also known as comparative negligence, states that if multiple parties are found to be at fault for an accident or injury, each party may be held responsible for a percentage of the damages based on their degree of fault.
Washington State follows the rule of pure comparative fault, which means that a plaintiff (the person bringing the lawsuit) can still recover damages even if they are found to be partially at fault for the accident or injury. However, the amount of damages that the plaintiff can recover will be reduced by their percentage of fault.
For example, if a plaintiff is found to be 30% at fault for an accident, and the damages are assessed at $100,000, the plaintiff would be entitled to recover $70,000 (i.e., $100,000 minus 30% for their own fault).
